The case that
I had filed against 247 Customer
Pvt Ltd got closed on 6th Feb 2009.
It took exactly 2 long years for
this to end. I got my relieving
letter as well.
I would like
to thank UNITES for taking up my
case. Especially I would like to
thank you for all the support and
help extended.

Hi all,
Thanks
for the information. I think its
very necessary to have an union
to protect our rights and to have
a better environment in the work
place. Could you please provide
me with detailed information about
the union so that I can communicate
the same to my fellow colleague's
and unite them together to join
the team. Also please let me know
whether we have to register for
this particular union and is there
any specific procedures to be followed.
I have visited this particular website
and have gone through the information,
However I would like to know more
about this. I will be eagerly waiting
for your response.

Dear Sir/Madam,
I am working
with the India based software company
in Bangalore for 2.5 years. I had
been with the Annual leave. They
lay off me in between my leave.
They did not tell any reason for
lay off. They lay off 11 members
include me in our branch office.
They had given one month notice.
Please tell our rights to work.

I
just went throught the newsletter
reg the topic "EMPLOYEES CHANT
LESS LEAVE, MORE WORK TO SAVE JOBS",
I feel, this is a some thing the
companies spread across to identify
them as genuine. Myself being an
IT professional and also from the
informations I got from my friends
and relatives working in IT, the
fact here is the companies reduce
head counts and deny leave to rest
of the employees thereby treating
them as slaves.

Dear
Sir,
I have faced series of harassment
for more than 6 months and forced
to resign from the Company. I was
hospitalized for working very long
hrs for my previous IT organization
when I was in UK from July 21st
2008 to August 19th 2008. I was
asked to return to India after getting
discharged from hospital. But I
have complained to UK employment
cell through hospital. I left UK
after providing written assurance
on my excellent performance in UK
project, nomination for promotion
and relocation to US.
But things were different after
returning to India. I was treated
very badly among colleagues. The
project was given to newly recruited
people and I was sidelined. HR has
changed the leave status in the
system even though it was promised
compensatory off and put me as loss
of pay.
Nothing
happened from my Manager and practice
HR even though I have written an
e-mail to CEO and COO. They started
harassing me saying that I have
accessed the company network when
I was in UK hospital, which was
completely false.
They
didn't approve my UK leave enhancement
approval after returning to India.
They tortured me in discussions
and private meetings.
Finally, they have rated me in the
last 5% rating even though they
provided in written that my performance
are highly valued and they would
recommend for promotion before leaving
UK.
I
have forwarded all the relevant
e-mails to my personal e-mail ID
for my protection, but they threatened
me with termination on code of conduct.
They did it when I requested for
performance discussion escalation.
The security was waiting outside
and they forced me to resign by
giving my ID cards and everything
at the same time otherwise they
said that they will write in my
conduct so that it will affect my
future career also. They promised
me that they would give 2 months
salary as per the contract, but
I yet to receive the same.
I
am jobless now even though I worked
and performed at the highest level.
I have enough e-mail and written
proofs to prove my stand.
I would like to know the different
options available to me, if I would
like to take legal action against
my previous company for discrimination
and emotional harassment and violation
of healthy labour conditions.
I appreciate your guidance on this,
as I am jobless now and facing financial
challenges also. Your help would
make a difference to my life. I
would like to discuss you regarding
this.
FYI…I have written the chronology
of events related to this case.

Here is the chronology of events
- I worked
hard almost 18-20 hrs for 4 months
for my company and hospitalized
by my wife on July 21st 2008..
- I was discharged
on 19th August with 1-week leave
from 12th August 2008
- My previous
company threatened me saying that
I need to return to India. But
I requested UK hospital
help on this and and they
spoke to my UK HR with respect
to that because it was clear discrimination.
- Finally,
my company offered me option of
promotion and assignment in US
with e-mail writing and signed
in company letterhead. I believed
them that point of time and accepted
the same, then came back to India
on 5th September 2008
- But my previous
company started treating me very
badly with plenty of humiliation
and emotional harassment even
knowing that I needed a good support
from the organization.
- I waited
till January 2009 to fulfill their
promises made to me on US project
and promotion. But shockingly,
they rated my performance as very
poor ( last 5% of people) even
though they appreciated my work
and promised for promotion for
my outstanding contribution to
HBOS UK project.
- On February
2nd , they threatened me with
termination because of the code
of conduct ( I have forwarded
some official e-mail in relation
to this issue of harassment
and humiliation to my
personal e-mail id for future
reference) and forced
me to resign from the
organization. If I am terminated,
it will affect my future career
and joining in other organizations.
I am having
all the e-mail communication with
respect to this issue and happy to
share with you if required.

Hello Sir,
I am already member of your group.I
joined Capgemini pune 0n oct-8 as
a consultant.Before Caps i worked
for tcs Pune.At the time of joining
they assured me for onsite opening
and good career at Capgemini. But
they hire me as a Proactive hire(for
bench not for any active assignment).They
did not clear anything regarding
this. Even at the Hr discussion
round i asked them for which Project
yu are hiring but they did not tell
me anything. Since october 08 i
was in bench at Caps.Their staffing
partner were not able to provide
me single project which were matching
to my skill.On Jan 21 they sacked
me.
People
sourcing person of caps anonymous
called me on 21 Jan and told me
that we are going to discontinue
your association with Caps due to
cuurent Business Scnario.and they
also take me signature in their
Hand made Resignation
letter.it is clearly mentoined in
the letter that i am resigning due
to our personal reason.When i asked
him about that and told them thatn
i will go to labour court for your
this drastic step they threat me
"that if yu did anything wrong then
we
will give yu negative background
report" if yu join any another company.
Since
then i am in deep shock.My family
is totally dependent on me .Capgemini
person ruined my career.When Capgemini
has not capability Hire me.
I left the company like TCS (which
is very safe)for you. Now since
one week I am in my home but I am
not getting single call from any
body's have several liabilities
Toward my family since I am the
only earning person in my whole
family.
If "Hiring And Firing is their policy"
then they have to informed me before
my joining to Caps.They people totally
ruined my career in this recession
time. If some thing wrong happenThen
only Caps people are totally responsible
for that.

On clicking on your name, I found
about your organization UNITES.
I have been looking for an organization
like yours where I could voice my
concerns.
I am a lady employee of ITC Infotech.
I have been suffering with some
of my fellow employees in this organization
since quite some time on account
of the list of things mentioned
here:

This list has not been made by me,
but this person is not exaggerating
when he has made this list.
I have suffered from most of these
things, the most important ones
being:
-Management treating juniors like
labourers and are not transparent
at all!!!
-When on bench, they asked us to
sharpen ourselves but did not even
bother to provide us with a place
to sit and a PC with internet that
can be used for our value-addition.
- Sexual harrassment that I could
not come forth with, because the
clauses in their policy were ones
that were well-defined and the harrasement
i suffered was comparatively indirect
- but cannot be denied as anything
too trivial.
- I know of an employee who wanted
to quit and who quoted "personal
reasons" as the reason for leaving.
She was ready to serve a 2-month
notice oeriod. But they wanted her
to serve a 3-month notice period.
She was asked to prove her personal
problems with documentary evidence!!
They probed into the matter until
they were convinced, thought her
appt letter clearly states that
she need not give any reason for
her leaving the organisation.
There is a lot more to be said,
but these are the biggest reasons.
Can you please help me raise my
voice against this org.
